The use of Purencool Digital copyright material

If you would like to reproduce, communicate, perform, adapt or broadcast any material where Purencool Digital owns the copyright for any other purpose other than those expressly permitted under the Copyright Act, you must receive written permission from Purencool Digital. It is important to keep in mind when asking for the use of Copyright you accurately and completely disclose the entire use of the material you want to use to Purencool Digital.

Fees for Permission

Copyright owners have the right to request a fee in return for giving permission for their material to be used. Fees will vary depending on the material involved, the intended use and the copyright owner's discretion. Fees may vary from a flat fee to a fee structure or percentage based on number of uses etc. Depending on the intended purpose, e.g. non-commercial or non-profit, and/or the material in question, some copyright owners may allow their material to be used free of charge. However, this will depend entirely on the copyright owner.

Use of personal information

Personal information you supply on-line will be used by Purencool Digital in conducting the business of Purencool Digital. Contact information from registration forms is used to get in touch with the visitor to a website when necessary, for example when the visitor is requesting the publication of notice of an event or seeking information about Purencool Digital.

Disclosure of personal information

Purencool Digital will not disclose personal information concerning you, including your email address, to parties outside Purencool Digital except in accordance with the Australia Privacy Act. Personal data maybe used only for statistical purposes or sending promotional material if authorised by the customer for purposes of promoting Purencool Digital services and products.

Public forums

Some of Purencool Digital sites may have chat rooms, forums, message boards, and/or news groups available to its users. Please remember that any information that is disclosed in these areas becomes public information and you should exercise caution when deciding to disclose your personal information.

Terms of payment

Terms of payment are direct credit. Credit terms are net 14 days upon receipt of invoice. We reserve the right to revoke any credit extended if payment is in arrears for more than 30 days.

Proprietary information

Proprietary information exchanged here under shall be treated as such by the client. This information shall include, but not be limited to, the provisions of this Agreement, product and services information and pricing. Client further agrees to not decompose, disassemble, decode or reverse engineer any  program, code or technology delivered to Client or any portion thereof.

Censorship

Purencool Digital will exercise control whatsoever over the content of the information passing through the network, email or website that affects the companies brand.

Warranties

Purencool Digital makes no warranties or representations of any kind, whether expressed or implied for the service it is providing. Purencool Digital also disclaims any warranty of merchantability or fitness for any particular purpose and will not be responsible for any damages that may be suffered by Client, including loss of data resulting from delays, non-deliveries or service interruptions by any cause or errors or omissions of Client. Use of any information obtained by way of Purencool Digital is at Client's own risk, and Purencool Digital specifically denies any responsibility for the accuracy or quality of information obtained through its services. Connection speed represents the speed of an end-to-end connection. Purencool Digital does not represent guarantees of speed or availability of end-to-end connections. Purencool Digital expressly limits its damages to Client for any non-accessibility time or other down time to the pro-rata monthly charge during the system unavailability. Purencool Digital specifically denies any responsibilities for any damages arising as a consequence of such unavailability.

Termination 

Purencool Digital may terminate this Agreement at its sole discretion upon the occurrence of one or more of the following events: 1) failure to comply with any provisions of the Agreement upon receipt of written notice from Purencool Digital of said failure, 2) appointment of Receiver or upon the filing of any application by Client seeking relief from creditors, 3) upon mutual agreement in writing of Purencool Digital and Client.

Disputes

If legal proceedings are commenced to resolve a dispute arising out of, or relating to, this Agreement, the prevailing party shall be entitled to recover all costs, legal fees, and expert witness fees as well as any costs or legal fees in connection with any appeals.

Indemnification

Client shall indemnify and hold Purencool Digital harmless from and against any and all claims, judgments, awards, costs, expenses, damages and liabilities (including reasonable attorney fees) of whatsoever kind and nature that may be asserted, granted or imposed against Purencool Digital directly or indirectly arising from or in connection with Client's marketing or support services of the product or services or the unauthorized representation of the product and services or any breach of this Agreement by Client.

General

If any provision of this Agreement is held to be unenforceable, the enforceability of the remaining provisions shall in no way be affected or impaired thereby. This Agreement shall be governed by and construed in accordance with the laws of the State of Victoria Australia. A failure by any party to exercise or delay in exercising a right or power conferred upon it in this Agreement shall not operate as a waiver of any such right or power.

 

Privacy Policy

Purencool Digital is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information. What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect includes names, addresses, email addresses, phone and facsimile numbers. This Personal Information is obtained in many ways including and from third parties. We don’t guarantee website links or policy of authorised third parties.


We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing. When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.


Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

•    For the primary purpose for which it was obtained
•    For a secondary purpose that is directly related to the primary purpose
•    With your consent; or where required or authorised by law.
 

Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

Your Personal Information may be disclosed in a number of circumstances including the following:

•    Where required or authorised by law.


Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorized access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.


Access to your Personal Information
You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing. Purencool Digital will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your personal information.

We  will  take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date.
